Bohire’s privacy commitment and accountability
This web site (this “Site”) is provided by Bohire Inc. (“Bohire”).
At Bohire, we are committed to protecting the privacy of personal information that you give to us. This policy is to inform you of how Bohire collects, uses and discloses your personal information for our business. In this policy, we refer to individuals seeking employment and career information through the Site ("Candidates"), Candidate referrers (“Referrers”) and employers seeking employees ("Employers").
 
Protection of Personal Information
Canadian law governs the collection, use and disclosure of personal information in a manner that recognizes individuals’ right of privacy with respect to their personal information.
The federal Personal Information Protection and Electronic Documents Act (“PIPEDA”) sets out rules and principles for the management of personal information by commercial organizations. Bohire’s services are made available to employers, referrers and candidates across Canada. PIPEDA applies to Bohire because Bohire has its headquarters, servers and databases in Ontario, Canada. This Privacy Policy adopts the standards required by PIPEDA and applies to all personal information submitted to or collected by Bohire.
The type of personal information that is protected includes almost any information about an identifiable individual, such as your name, address, and telephone number. Personal information may not, however, include certain types of business or employment related information. It does not, for example, include the name, title, business address or telephone number of an employee of an organization. Information contained in resumes that are stored on this Site may constitute personal information and would be subject to this Privacy Policy.
PIPEDA provides certain fundamental principles which apply to the collection, use and disclosure of your personal information. One of the most significant, is that your personal information generally cannot be collected, used or disclosed without your consent. It also allows you to find out why your personal information is being collected, how it is being used, where it is being stored and to whom it is disclosed. It requires the use of appropriate safeguards to secure your personal information. It also grants you access to your personal information and provides mechanisms for ensuring compliance.
Bohire does not collect, use or disclose your personal information without your consent except where required or allowed by law.
 
What Information Do We Collect
Bohire limits the collection of your personal information to that which is required or permitted by law. Bohire collects such personal information as is required for the purposes identified by us in this Privacy Policy or identified by us at the time that we collect the information from you.
Bohire requests certain information from you if you elect to register as a Referrer of this Site (“Referrer Sign Up”). Sign up information includes your full name, email and mailing address. Before a referral fee can be paid to a Referrer, the Social Insurance Number of the Referrer must be provided to Bohire for purposes of reporting required under the Income Tax Act(Canada).
If you are a Candidate your application (“Candidate Profile”) will be stored on our Site. Candidate information includes your full name, email, mailing address, employment information, and information about your education. You may also elect to store your resume on our Site. The extent of the information that is collected when you submit your resume depends on what you choose to place in your resume.
Bohire requests certain information from you if you elect to register as an Employer of this Site (“Employer Sign Up”). Sign up information includes your full name, contact details, and other company related information like your website address and company description.
At times, we may ask you to provide us with general information (“User Information”) about you to assist us in meeting your various needs or to better understand the requirements, profiles and experience of our Site visitors. This information includes information that is collected if you choose to be kept updated about new developments or services offered by Bohire, or if you contact Bohire.
The purposes for which we collect any information will always be as set out in this Privacy Policy or as otherwise expressly communicated to you before we collect the information.
We do not knowingly solicit information from children and we do not knowingly market our services to minors.
 
How We Collect Personal Information
Bohire collects your personal information, for the identified purposes, in a number of ways, including:
As a Referrer: when you sign up as a Referrer and complete the Referrer Sign Up
As a Candidate: when you or the Referrer complete the Candidate Profile, submit a resume, submit any additional supporting documents and/or provide any other information
As an Employer: when you sign up as an Employer and complete the Employer Sign Up.
 
Identify the Purpose for Holding Personal Information
If you are a Candidate, the information contained in your Candidate Profile, your resume and any additional documentation you provide to your Referrer(s) will not be accessible to the public. Except as otherwise set out in this Privacy Policy, the only parties that have access to your information are:
 
Your Referrer(s). Your Referrer(s) will access your information for the purpose of identifying potential job openings for you and referring your information to potential employers.
Employers. Employers will receive your information when your Referrer submits your information to the Employer. Your personal information will be disclosed to Employers for the purposes of assessing your suitability for employment.
If you are a Referrer, the information contained in your Referrer Sign Up and any additional information you provide will not be accessible to the public. Except as otherwise set out in this Privacy Policy, the only parties that have access to your information are:
 
Your Candidate(s). A Candidate referred by you to an Employer will have access to your information for the purpose of identifying the party who referred the Candidate to an Employer.
Employers. Employers will receive your name (or Site nickname, if used) when you refer a Candidate to the Employer. Employers will have access to the comments and ratings received by you from Employers.
If you are an Employer, the information contained in your Employer Sign Up will not be accessible to the public. Your company name and your job postings will be accessible to the public at the Site.
We will not sell, trade, rent or license personal information that you provide to us.
Bohire uses Beanstream (the “Payment Processor”) to process credit card and other payment transactions. This will not affect Candidates using our Site. The Payment Processor is required to comply with privacy laws and principles comparable to ours. All credit card transactions are completed using secure electronic encryption.
We may disclose your personal information to third parties who acquire all or a substantial part of the Bohire business, including by merger, amalgamation, a sale of our assets or in the unlikely event of bankruptcy. Subject to a court order, at the time of such merger, amalgamation, sale or bankruptcy, Bohire will contractually require any resulting entity that obtains your personal information to comply with its obligations under PIPEDA regarding your personal information, including the applicable terms and conditions of this Privacy Policy.
We may also disclose your personal information to the following parties outside of Bohire:
 
government bodies or law enforcement agencies as required or authorized by law;
Any other person or organization not referred to above if you have given us specific consent to share your personal information with such person or organization
Personal information collected from Site visitors may be used to (a) send you information about Bohire and promotional material that we believe may be useful, and (b) to analyze this information for trends and statistics.
 
Cookies
"Cookies" are a standard for storing small pieces of data on a web client (i.e. the web browser on your computer). This Site may store cookies on your web client in order to better serve you upon your subsequent visits to this Site. By using cookies, we may track information about your usage of the site and provide customized content to you. Note that some browsers can be configured to allow cookies to be accessed by servers other than the originating server. Please note that most web browsers can also be configured to notify the user when a cookie is received, allowing you to either accept or reject it.
 
Obtain Consent
We seek and confirm consent from Employers and Referrers to use their personal information as set out above at the time we first collect their personal information.
We do not deal directly with Candidates and instead a Candidate’s personal information is set out in the profile provided by a Referrer to an Employer. Before a Referrer may submit a Candidate’s profile to an Employer, the Referrer must confirm to us that the Candidate has given permission for that submission.
If you subsequently supply further personal information, we assume that the consent we originally received is applicable to personal information supplied at a later time, provided the purposes are the same as have been identified in this document. Consent may be expressed (in writing or verbally), or it may be implied, such as when you send us unsolicited personal information, in paper copy or electronically. Your consent can be withdrawn if you notify our Privacy Officer in writing.
If you do not wish to have your personal information used for a particular purpose or you do not wish to receive mailings, you can e-mail us to notify us of your wishes.
 
Use Appropriate Safeguards
We will take appropriate measures to ensure that personal information you have supplied is stored securely, whether in electronic form or otherwise.
Unfortunately, no data transmission over the Internet can be guaranteed as totally secure. Accordingly, although Bohire strives to protect such information, Bohire cannot ensure or warrant the security of any information you transmit to us or from our online services and you do so at your own risk. Once we receive your transmission, we will take reasonable steps to preserve the security of this information in our own systems.
If you have a login name and/or password for use in conjunction with this Site, you are entirely responsible for the maintenance of the confidentiality of that login name and/or password. Furthermore, you are entirely responsible for any and all activities that occur under your login name. You agree to immediately notify Bohire of any unauthorized use of your login name and/or password or any other breach of security known to you.
Bohire makes every effort through contractual means and through the use of login names and passwords to restrict those who have access to our Site other than for the purpose of fulfilling a job posting. However, Bohire cannot guarantee that all Employers, Referrers, Candidates and other persons with access will adhere to the limitations that we impose on them, or that unauthorized persons will not gain access to the database.
If at any time you would like your information removed from our Site, you may do so as follows:
 
If you are a Candidate and wish to remove your information from this Site, please email Bohire at deletecandidate@bohire.com. Please include your name and the name(s) of your Referrer(s). Your Referrer may also remove your information from this Site by deleting you Candidate Profile. However, Employers who have previously received your information may have retained a copy of your information in their own systems and databases.
If you are a Referrer and wish to remove your profile you may do so in the Edit My Profile section. Alternatively you may email Bohire at deletereferrer@bohire.com. You MUST email this request from the email address you used to register your account.
If you are an Employer and wish to remove your profile you may do so in the Edit My Profile section. Alternatively you may email Bohire at deleteemployer@bohire.com. It is preferred that you email this request from the email address used to register the account but if this is not possible you MUST provide your name and contact information so we can validate this request.
Although we use all reasonable means to ensure that the information you provide to us is not used by third parties for purposes other than those described in this Privacy Policy, Bohire is not responsible for any improper use of your personal information that is beyond our reasonable control
This Site may contain links to other sites, including those of our business partners, vendors and advertisers. While we try to link only to sites that share our high standards and respect for privacy, please understand that we are not responsible for the content of, or the privacy practices employed by, other sites.
All Bohire staff are required to sign confidentiality agreements
 
Information Retention
We rely upon you to notify us of any changes in your personal information that you consider important, in order that we can keep your personal information up to date. Where we determine that your personal information is no longer required for any purpose we have identified to you, we will take reasonable steps to ensure that it is disposed of in a secure manner or rendered anonymous. Some personal information must be retained for specific periods to comply with various laws.
We do not retain a copy of the emails you use for the “invite a referrer” or “invite a candidate” feature.
 
You Can Access Your Personal Information
Subject to some exceptions provided by law, you have a right to access the personal information that we retain about you, how we use it and to whom it has been disclosed. If you would like to do so, for security reasons, you will be required to put your request in writing. When making your request please provide the following:
The reason for your request
Your mailing address
Your email address (the one used on the Site)
If applicable, the name of your Referrer(s)
A photocopy of the front and back of your driver’s license

Further, you may be charged a small administrative fee for searching for and providing access to your information (we will advise you of the fee at the time of your request). You should address any request for access to our Privacy Officer.

 
Challenging Compliance
You have the right to contact us if you feel we have collected, used, or disclosed your personal information in an improper way. You may do so by contacting our Privacy Officer in writing and you will be entitled to a response within 30 days. Once a decision has been rendered, you will receive a copy of this decision by mail.  A copy of the decision will also be filed in our records.  A copy of the documentation used to arrive at the decision will also be filed in our records.  If you feel further action is required to address your complaint, you may seek the involvement of the Privacy Commission in Ottawa.
